How we handle it
We buy the property subject to the existing tenancy. Whatever the lease says, we inherit it at closing along with the security deposit, and the tenant relationship becomes our problem from that moment on. You do not serve a notice, you do not negotiate a cash-for-keys deal, and you do not manage a move-out.
We do not need the unit made ready. Worn carpet, a kitchen from the Clinton administration, an overgrown yard, damage the last tenant left behind, all of it is priced in, and none of it needs your money first. Do I need to evict my tenants before selling?
No, and we would rather you did not. Evictions are slow, expensive, and in Utah they create a court record that complicates the file. We buy occupied properties routinely and handle the tenant relationship after closing.
What happens to the security deposit?
It transfers to us at closing, normally as a credit on the settlement statement, and we take on the obligation to account for it under Utah's Fit Premises Act. You will want to give the tenant written notice of the change in ownership and where the deposit now sits; we will help make sure that gets done properly.
My tenant is behind on rent. Does that lower your offer?
Not usually. We are underwriting the property, not the current rent roll's performance. Past-due rent you are owed does not transfer to us, so if you want to pursue it that remains yours to pursue, most owners in this position decide it is not worth the effort and are glad to be out.
